The government has been restrained from any further action to retire Ms. Athena Marche, who currently holds the position of Deputy Financial Secretary, pending judicial review.

Ms. Marche attended a meeting with Financial Secretary, Simon Wilson on April 24th, 2023 where she was presented with the option to either transfer to the University of The Bahamas or face a recommendation for retirement. The ultimatum was based on a memorandum prepared by former Acting Financial Secretary, Marlon Johnson, which stated that there were issues regarding Ms. Marche’s performance difficulties and insubordinate behaviour. She was invited to respond by the end of business on May 1st, 2023.

Ms. Marche disputed the allegations against her, challenged the procedure followed and requested prove of her alleged misconduct through a letter sent by her attorney Kahlil Parker KC. She was placed on administrative leave for two weeks via a letter dated March 11th, 2023. In March 2024, it was recommended that Marche be retired in the public interest. She was invited to show cause why she should not be retired within 14 days.

Ms. Marche sought a judicial review in May 5th, 2025.

The ruling was handed down by Justice Leif Farquharson.
